These Terms and Conditions ("Terms") govern access to and use of the "Menu My" digital restaurant management platform.

By creating an account, subscribing, or using the Software, you ("Customer", "you") agree to be legally bound by these Terms. If you do not agree, you must not use the Software.


1. Description of Service

The Software provides digital restaurant management tools, which may include but are not limited to QR menus, menu management, ordering features, analytics, integrations, and related services.

We may modify, update, or discontinue features of the Software at any time without liability.


2. Eligibility and Account Responsibility

You confirm that:

  • You are at least 18 years old
  • You have authority to bind the business you represent
  • All information provided is accurate and current

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity occurring under your account
  • Ensuring your hardware, internet connection, and devices are compatible

3. Subscription, Fees, and Payments

  • Access to the Software may require payment of subscription fees if displayed at sign-up.
  • Fees are non-refundable, except where required by Australian Consumer Law.
  • We may change pricing with reasonable notice.
  • Failure to pay may result in suspension or termination of access.

4. Acceptable Use

You must not:

  • Use the Software for unlawful purposes
  • Upload false, misleading, or infringing content
  • Attempt to reverse engineer, copy, resell, or exploit the Software
  • Interfere with system security, uptime, or performance

We reserve the right to suspend or terminate accounts for misuse.


5. Customer Content and Data

You retain ownership of any content you upload (menus, pricing, images, descriptions).

You grant us a non-exclusive, worldwide, royalty-free licence to use, host, store, and display your content solely for operating the Software.

You are responsible for the accuracy, legality, and compliance of all content you upload, including pricing and allergen information.


6. No Guarantee of Performance

The Software is provided on an "as is" and "as available" basis.

We do not guarantee that:

  • The Software will be uninterrupted, error-free, or always available
  • Any specific increase in revenue, sales, efficiency, or customer satisfaction will result from using the Software

7. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any:

  • Loss of revenue, sales, profits, or business
  • Business interruption
  • Loss of data or corruption of data
  • Indirect, incidental, special, or consequential damages
  • Errors, downtime, delays, or system failures

This applies whether the claim arises in contract, negligence, tort, statute, or otherwise.


8. Third-Party Services and Integrations

The Software may integrate with third-party services (e.g. payment processors, hosting providers).

We are not responsible for:

  • Failures, outages, or errors of third-party services
  • Data loss or issues caused by third-party platforms

Your use of third-party services is governed by their own terms.


9. Indemnity

You agree to indemnify and hold us harmless from any claims, losses, damages, or expenses arising from:

  • Your use of the Software
  • Your content
  • Your breach of these Terms
  • Claims made by your customers or third parties

10. Intellectual Property

All Software, code, designs, trademarks, and documentation remain our exclusive intellectual property.

You receive a limited, non-transferable, revocable licence to use the Software while your account is active.


11. Suspension and Termination

We may suspend or terminate your access:

  • For breach of these Terms
  • For non-payment
  • For security or legal reasons

You may cancel your subscription at any time. Upon termination:

  • Access will cease
  • Data may be deleted after a reasonable period

12. Privacy

Use of the Software is also governed by our Privacy Policy, which explains how we collect and handle personal information in accordance with Australian Privacy Laws.


13. Australian Consumer Law

Nothing in these Terms excludes rights you may have under the Australian Consumer Law that cannot be excluded. Where warranties cannot be excluded, our liability is limited to resupply of the service or payment of the cost of resupply.


14. Governing Law

These Terms are governed by the laws of Australia, and the relevant states.


15. Changes to These Terms

We may update these Terms from time to time. Continued use of the Software constitutes acceptance of the updated Terms.
